Terms & Conditions
1. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
2. Cancellation Policy
If the customer cancels the booking after confirmed order has been placed, the vehicle has been dispatched or has arrived at the agreed location. Martha L Judge LTD reserves the right to charge a cancellation fee equivalent to the full quoted rate to cover incurred costs.
3. Access and Liability
The customer is responsible for ensuring safe and suitable access for the vehicle from a public highway unless otherwise explicitly agreed in writing.
Any request by the customer for the vehicle to leave the public highway onto private property will be entirely at the customer’s risk. Martha L Judge LTD will not be liable for any damage caused to surface, underground utilities, overhead services, or property in connection with fulfilling the customer’s request.
The customer agrees to indemnify Martha L Judge LTD against any claims arising from damage caused by accessing private property at the customer’s request.
4. Permits and Legal Access
Where access to the public highway or a restricted area requires a permit, it is the customer’s responsibility to obtain and provide evidence of the required permissions. Martha L Judge LTD will not be held liable for fines and delays resulting from failure to secure necessary legal access.
5. Surface Protection and Damage
The customer acknowledges responsibility for protecting all surfaces where waste collection or material delivery will take place. Martha L Judge LTD will not be liable held liable for any damage to driveways, pavements, gardens, landscaping, or other surfaces during service operations.
If protection of surfaces is required, the customer must arrange suitable protection (e.g., hardwood sheets) at their own expense prior to commencement of works.
6. Material Specification and Waste Disposal
The customer is responsible for clearly specifying the type and condition of material to be collected or delivered. Incorrect specification leading to contamination or refusal at disposal or delivery points will incur additional cost, which will be passed onto the customer.
7. Hazardous or Prohibited Materials
The customer must not present hazardous, toxic, flammable, explosive, or otherwise prohibited materials for collection or delivery unless explicitly agreed in writing. Any breach of this condition may result in immediate termination of service and additional charges.
8. Overloading and Safety Compliance
Martha L Judge LTD reserves the right to refuse loading materials that exceed the maximum allowable weight, volume, or dimensions. Any costs incurred due to delays or repeated trips caused by unsuitable loading practices will be charged to the customer.
9. Service Limitations
Vehicles have physical limitations regarding reach, load weight, and tipping clearance. The customer is responsible for understanding these limitations and ensuring the job is suitable for the service provided. No refunds or discounts will be issued for service will be issued for service non-fulfilment due to incompatibility with site conditions.
10. Time Allowance and Additional Time Charges
Grab hire services include a maximum loading time of 20 minutes on site. Material delivery services include a maximum unloading time of 10 minutes on site. Any additional time required beyond these allowances is chargeable at the discretion of Martha L Judge LTD.
11. Waiting Time and Sight Delays
If the driver is unable to commence work upon arrival due to site access issues, lack of readiness, or customer delay, waiting time will be chargeable beyond the included time allowance. This includes delays due to blocked access, site personnel unavailability, or failure to provide required permits.
12. Pricing and Additional Charges
Quotations provided are based upon information given by the customer at the time of booking. Any changes, additional loads, or unforeseen circumstances not disclosed at booking may incur additional charges.
13. Payment Terms
Payment is due upon receipt of invoice unless otherwise explicitly agreed. Late payments may incur additional fees and interest at statutory rates.
14. Customer Presence and Authorisation
A responsible person must be present on-site at the agreed time to guide the operation and approve the position for loading/unloading. If no one is available, the driver will use their best judgement; Martha L Judge LTD accepts no liability for decisions made in the absence of the customer or representative.
15. Driver’s Right to Refuse Service
Our drivers reserve the right to refuse to operate machinery or unload in any situation they deem unsafe or likely to result in damage, injury, or legal violation. This includes unstable ground, overheard obstructions, or unclear instructions. In such circumstances, Martha L Judge LTD reserves the right to apply cancellation or call-out charges to cover incurred costs.
16. Photos and Evidence
Martha L Judge Ltd reserves the right to take photographs or video of the delivery or collection site before, during and after operations for evidence in the event of a dispute regarding damage, delays or service fulfilment
17. Returns and Haulier charges
If the customer elects to return any materials, Martha L Judge Ltd will arrange collection at the customers request. All return trips are chargeable at the Hauliers prevailing rate, which covers vehicle hire, driver time, fuel, and administration. Charges will be based on:-
- Distance: Measured from the original delivery/Collection point to the return drop-off location and back to the depot, at the hauliers standard mileage rate.
- Time: Including loading/unloading time beyond the included allowance (20 min for loading, 10 Mins for unloading) billed at the hauliers hourly labour rate.
- Weight/Volume: If applicable, at the rate quoted for additional tonnage or cubic capacity. All return charges are subject to VAT at the applicable rate and are payable in accordance wit the standard payment terms (see clause 13). By requesting a return, the customer acknowledges and accepts these haulier charges in full.
18. Price Variations
Martha L Judge Ltd does not offer fixed price quotations. Due to ongoing market uncertainty including fluctuations in fuel costs, haulage rates, and operating expenses – Martha L Judge Ltd reserves the right to increase any prices quoted at any time prior to acceptance, and, once accepted, at any time prior to completion of the services.
19. Force Majeure
Martha L Judge Ltd shall not be liable for any delays, interruptions, or failures arising from circumstances beyond its reasonable control, including, but not limited to, weather conditions, strikes, breakdowns, road closures, or regulatory restrictions.
20. Customer Default; Right to Return Waste Materials
20.1 If the customer fails to pay any sums due under these terms & conditions with 14 days of the due date, or otherwise materially breaches any obligation under these Terms (including, without limitation, mis-specification of material, non-payment of additional time or wrong-waste charges), Martha L Judge Ltd shall have the right, at its sole discretion and without prejudice to any other rights or remedies: (a) to suspend further collection or delivery services; (b) to place a lien over all waste materials in its possession until full payment is received; and/or (c) to return, re-deliver or offload any waste materials already collected to the customers premises (or such location as the customer may specify) at the customers expense.
20.2 All costs incurred by Martha L Judge Ltd in exercising its rights under clause 20.1 (c) – Including haulage, labour, disposal, re-handling, storage and any incidental administrative charges – shall be charged to and payable by the customer, together with VAT, in accordance with the standard payment terms (clause 13).
20.3 Martha L Judge Ltd may dispose of or re-dispatch materials if the customer fails to take delivery within 7 days of being notified of intention to return the waste, and the customer shall remain liable for all costs incurred.
20.4 These rights are without prejudice to Martha L Judge Ltd right to claim interest on late payments and to recover any additional losses suffered as a result of the customers breach.
By using Martha L Judge Ltd, the customer confirms their acceptance of these Terms and Conditions.
